Terms of Service

These Terms of Service are a template provided for convenience and should be reviewed by qualified legal counsel before you rely on them. They do not constitute legal advice.

1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of WindshieldMatch.com (the “Site”), owned and operated by Bang AutoGlass LLC (“WindshieldMatch,” “we,” “us,” or “our”). By accessing or using the Site, submitting a quote request, or purchasing or maintaining a listing or subscription, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site. You must be at least 18 years old to use the Site.

2. Description of the Service

WindshieldMatch.com is an online directory and lead-introduction service. We help drivers find and connect with independent third-party auto-glass and windshield repair and replacement shops. When a driver submits a quote request, we share that request with one or more shops (typically up to about four) who may contact the driver to provide quotes.

WindshieldMatch is not the provider of auto-glass repair or replacement services through the matching service. We do not perform, supervise, warrant, or guarantee any repair, replacement, calibration, or other work performed by any shop. Shops are independent businesses, not our employees, agents, or partners. Any contract for auto-glass work is solely between the driver and the shop. We do not guarantee the quality, pricing, availability, licensing, insurance, or workmanship of any shop, and we are not responsible for any transaction, dispute, or outcome between drivers and shops.

Operator/affiliate disclosure: WindshieldMatch.com is owned and operated by Bang AutoGlass LLC, an auto-glass company operating in Florida and Arizona. Bang AutoGlass LLC also lists itself as a shop on the directory and may be among the shops a driver is matched with. We strive to operate the directory fairly, but you acknowledge this affiliation.

3. Driver Terms

If you submit a quote request as a driver, you agree to the following.

  • Accurate information. You will provide accurate contact and vehicle information, and you represent that the phone number and email you provide are yours or that you are authorized to provide them.
  • Consent to be contacted (including by phone and SMS). By submitting a quote request, you expressly consent to be contacted by WindshieldMatch and by the auto-glass shops we share your request with, at the phone number(s) and email address(es) you provide, regarding your request and related services. You agree that this contact may include phone calls, text messages (SMS/MMS), and emails, and that these may be made or sent using automated technology where applicable. Consent to receive marketing or autodialed/prerecorded calls or texts is not a condition of any purchase. Message and data rates may apply. You can opt out of text messages by replying STOP, and you can ask any shop or WindshieldMatch to stop contacting you. Carriers are not liable for delayed or undelivered messages.
  • Quotes are estimates from third parties. Any quotes, prices, timelines, or other information you receive come from independent shops, are estimates only, and are subject to change. WindshieldMatch does not set, control, or guarantee any quote or price.
  • No fee to drivers. Using the matching service to request quotes is free for drivers.
  • Your responsibility. You are solely responsible for evaluating shops, verifying their credentials, and deciding whether to do business with them.

4. Shop and Business Terms

If you are an auto-glass shop or business that claims a listing, creates an account, purchases a subscription, or receives leads, the following additional terms apply.

  • Subscriptions and fees. We offer paid subscriptions and charge per-lead (shared-lead) fees. By purchasing, you authorize us and our payment processor (Stripe) to charge your designated payment method for all applicable subscription and per-lead fees on a recurring or per-transaction basis, as described at the point of purchase, until you cancel.
  • Billing authorization and renewal. Subscriptions renew automatically unless cancelled before the renewal date. You are responsible for keeping your payment information current. You authorize recurring charges until you cancel.
  • Non-refundable. Except as expressly provided in our published refund policy or as required by law, all subscription fees and per-lead/shared-lead fees are non-refundable, including for leads that do not convert.
  • No guarantee of leads. We do not guarantee any minimum volume, quality, exclusivity, accuracy, or conversion of leads. Leads are typically shared with multiple shops. A lead represents a driver’s request, not a confirmed customer or sale.
  • Listing data. Directory listing data is compiled in part from publicly available sources. Shops may claim, edit, or request removal of their listing by emailing support@windshieldmatch.com. You represent that information you submit about your business is accurate and that you are authorized to provide it.
  • Acceptable use. You agree to contact drivers only in connection with their request, to comply with all applicable laws (including TCPA, CAN-SPAM, and state telemarketing and consumer-protection laws), to honor opt-out requests, and not to resell, scrape, or misuse lead data or directory content.

5. Acceptable Use (All Users)

You agree not to: (a) use the Site for any unlawful purpose; (b) submit false, misleading, or fraudulent information; (c) scrape, harvest, or copy Site content or data except as expressly permitted; (d) interfere with or disrupt the Site or its security; (e) harass, abuse, or harm others; or (f) infringe the rights of WindshieldMatch or any third party.

6. Disclaimers; “AS IS”

THE SITE AND ALL SERVICES, LISTINGS, AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT LISTING INFORMATION IS ACCURATE OR COMPLETE. WE MAKE NO WARRANTY REGARDING ANY SHOP, ANY QUOTE, OR ANY AUTO-GLASS WORK, ALL OF WHICH ARE PROVIDED BY INDEPENDENT THIRD PARTIES.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINDSHIELDMATCH AND BANG AUTOGLASS LLC, AND THEIR OWNERS, OFFICERS, EMPLOYEES, AND AGENTS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY INTERACTION WITH OR WORK PERFORMED BY ANY SHOP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

8. Indemnification

You agree to indemnify, defend, and hold harmless WindshieldMatch, Bang AutoGlass LLC, and their owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any law or third-party right, or (for shops) your contact with or services provided to drivers.

9. Intellectual Property

The Site, including its design, text, graphics, logos, and software, and the WindshieldMatch name and brand, are owned by or licensed to Bang AutoGlass LLC and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Site for its intended purpose. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without our prior written permission.

10. Termination

We may suspend or terminate your access to the Site or any account, and remove any listing, at any time and for any reason, including for violation of these Terms, with or without notice. Upon termination, your right to use the Site ceases. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

11. Governing Law

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.

12. Dispute Resolution; Arbitration; Class-Action Waiver

Please read this section carefully — it affects your legal rights.

Except for claims that may be brought in small-claims court, you and WindshieldMatch agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration, rather than in court. Arbitration will be administered by a recognized arbitration provider under its applicable rules, and will take place in Florida or another mutually agreed location (or by remote means where permitted). Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and WindshieldMatch agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding.

If any portion of this Section is found unenforceable, the remainder will continue to apply, except that if the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court rather than arbitration. To the extent any dispute proceeds in court, you and WindshieldMatch consent to the exclusive jurisdiction and venue of the state and federal courts located in Florida.

13. Changes to These Terms

We may modify these Terms at any time. When we do, we will revise the “Effective Date” above and post the updated Terms on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

14. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and WindshieldMatch regarding the Site. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely.
